Christina May Bolin and Gaby Reeves secured a victory for an employer in a case in which the plaintiff, a teacher, claimed she was entitled to additional workers’ compensation benefits for the summer break, arguing that the employer failed to assign her a light-duty position. She further claimed that she was entitled to medical expenses for treatment of her on-the-job injuries from an unauthorized physician received after her authorized treating physician placed her at MMI.
Christina and Gaby successfully defended these claims, arguing that the plaintiff had no reasonable expectation of returning to work because no classes were held during the summer break and that she was not entitled to additional medical expenses because the physician from whom she received treatment after being placed at MMI was not an authorized treating physician, nor had any authorized treating physician referred her to him. The Court agreed, entering an Order dismissing all claims against the client; the Order stated the arguments set forth in Christina and Gaby’s brief verbatim.
