Christian & Small attorneys Sharon D. Stuart and Jonathan M. Hooks recently secured a full dismissal, with prejudice, of a pharmaceutical manufacturer from a serious personal injury lawsuit. The suit was filed by a plaintiff whose child was born with profound birth defects, and she alleged that the drug — administered to the mother before she conceived the child — had caused those defects. Stuart and Hooks obtained dismissal of the complaint on the grounds of federal preemption.
