Bob Cooper obtained a defense verdict on February 6, 2014 in favor of a pediatrician in a wrongful death action. The patient died on August 17, 2009, with an autopsy revealing an epidural hematoma. The plaintiff alleged that the pediatrician, who saw the decedent on August 16, 2009 for a regularly scheduled appointment, failed to diagnose a skull fracture and an epidural hematoma and should have ordered a CT scan. There were no neurological signs or symptoms on clinical examination that would warrant a CT scan. The plaintiff’s experts included a board certified neurosurgeon and a board certified pediatrician. In addition to the testimony of the defendant pediatrician, defense experts included a physician board certified in both pediatrics and pediatric neurology and a board certified pediatrician.  After a trial of several days, the jury returned a verdict in favor of the pediatrician and his practice group.
