UPDATE: Plaintiff subsequently filed an appeal with the Alabama Supreme Court. On August 16, 2013 , the Alabama Supreme Court affirmed the jury verdict in favor of the defendants.
In March 2012, Jim Carlson, Eddie Elliott, Deborah Alley Smith, and Steven Nichols obtained a defense verdict in a wrongful death case brought against the designer, manufacturer and distributor of a zero turn riding mower, all of whom were represented by the firm.  Plaintiff’s decedent was killed when the mower rolled over on top of him.  The plaintiff sued under a products liability theory, claiming that the subject mower was defective and unreasonably dangerous.    After a three week trial in the Circuit Court of Chilton County, Alabama, the jury returned a verdict in favor of the defendants.
Plaintiff subsequently filed a Motion for New Trial, which was denied.
